1. General provisions
1.1. These Terms and Conditions of Sale (hereinafter – the Terms) govern the mutual rights, obligations and liability between the Buyer and the Seller when the Buyer purchases goods in the online store www.fila3d.lt (hereinafter – the Online Store).
1.2. The owner of the Online Store and the Seller is: Ričardas Čepukonis, carrying out activities under an individual activity certificate, activity number 1260759, VAT number LT100016370919, address Pramonės pr. 45-53, LT-50462 Kaunas, Lithuania, phone +370 657 88474 (hereinafter – the Seller).
1.3. These Terms apply to all Buyers placing orders in the Online Store, including consumers (natural persons purchasing goods for personal, family or household purposes).
1.4. By placing an order, the Buyer confirms that they have read these Terms and agree to be bound by them.
2. Conclusion of the sales contract
2.1. The sales contract between the Buyer and the Seller is deemed concluded from the moment when the Buyer in the Online Store forms a shopping cart, provides the required data, chooses the payment and delivery method, confirms that they have read the Terms, and clicks the “Confirm order” button or its equivalent.
2.2. Each contract concluded between the Buyer and the Seller is stored in the Seller’s information system under the procedure set by the Online Store.
2.3. The Seller has the right not to confirm or to cancel an order if the Buyer fails to comply with the Terms, does not provide the necessary data, or if for objective reasons the Seller is unable to fulfil the order (for example, the goods are out of stock).
3. Goods, prices and information
3.1. The Online Store sells 3D printing materials and other goods, whose main characteristics are indicated in the description of each item.
3.2. All prices of goods are indicated in euros and include VAT (unless stated otherwise), and are valid at the moment the Buyer places the order.
3.3. Product photos are for illustrative purposes only and may slightly differ from the actual goods (shade, packaging, label design, etc.). Colour representation may differ due to display settings and this is not considered a defect of the goods.
3.4. Colour, gloss or surface structure of individual batches of 3D filaments may slightly differ, which is typical for this type of products and is not considered a material defect of the goods, provided that the manufacturer’s technical specifications are met.
4. Payment terms
4.1. The Buyer may pay for the goods using the payment methods indicated in the Online Store (e.g. online banking, payment cards, payment initiation services, advance bank transfer, etc.).
4.2. The Buyer undertakes to pay immediately after placing the order, unless otherwise agreed (for example, a separate agreement for deferred payment).
4.3. The order is processed only after full payment has been received in the Seller’s account, unless otherwise agreed.
5. Delivery of goods
5.1. Goods are delivered using the method chosen by the Buyer and indicated in the Online Store (e.g. parcel terminals, courier service, collection at an agreed location, if available) within the territory of the Republic of Lithuania and/or other Baltic countries, if such option is provided.
5.2. Delivery times (for example, 1–3 business days in Lithuania after receipt of payment) are indicated next to the delivery method; they are indicative and may change due to reasons beyond the Seller’s control (e.g. courier operations, public holidays, force majeure).
5.3. The Buyer undertakes to provide accurate delivery details. If the Buyer provides incorrect address or other data, they bear the consequences of any delays or non-delivery.
5.4. The moment of transfer of the goods to the Buyer is the date when the goods are handed over to the courier or parcel terminal and collected by the Buyer. From this moment the risk of accidental loss or damage of the goods passes to the Buyer.
6. Product quality, warranty and liability
6.1. Goods may be covered by the quality warranty granted by the manufacturer, if such warranty is indicated for a specific product. Warranty terms may be described separately or provided by reference to the manufacturer’s instructions.
6.2. Upon receipt of the shipment, the Buyer must check its condition and immediately inform the Seller and/or the delivery service provider of any visible damage or missing items, in accordance with their rules.
6.3. The Seller is not liable for the fact that the colour, shape or other parameters of goods displayed in the Online Store may not fully match the Buyer’s expectations if such discrepancies are due to the Buyer’s display settings or other technical reasons.
7. Right of withdrawal and returns
7.1. A consumer (natural person) has the right to withdraw from a distance contract without giving any reason within 14 calendar days from the day of receipt of the goods, by notifying the Seller in writing.
7.2. Unless otherwise required by law, the Buyer sends returned goods at their own expense, except in cases where faulty goods are returned or the return is due to the Seller’s fault.
7.3. Returned goods must be undamaged, unused, with all labels and in their original, clean packaging, having retained their commercial appearance.
7.4. After receiving the returned goods and verifying that they meet the return conditions, the Seller refunds to the Buyer the amount paid for the goods within the time limit established by law (usually within 14 days) to the account specified by the Buyer.
7.5. Certain goods cannot be returned under the applicable legal acts (for example, goods manufactured according to the Buyer’s individual specifications); in such cases this is indicated next to the respective product or in the Online Store information.
8. Buyer’s rights and obligations
8.1. The Buyer has the right:

To purchase goods in the Online Store in accordance with these Terms and the laws of the Republic of Lithuania.

To demand that defects of goods be rectified, faulty goods be replaced, or the money be refunded, in accordance with the applicable laws.
8.2. The Buyer undertakes:

When using the Online Store, to provide only correct and complete data.

Not to use the Online Store for unlawful purposes or in a way that infringes the rights and legitimate interests of third parties.
9. Seller’s rights and obligations
9.1. The Seller has the right:

To temporarily or permanently suspend the operation of the Online Store, change its functions, as well as amend the Terms, by publishing the updated information in the Online Store.

Not to fulfil the order if the Buyer fails to comply with these Terms or the Seller’s instructions.
9.2. The Seller undertakes:

To provide the Buyer with access to the services of the Online Store.

To respect the Buyer’s right to personal data protection and to process data in accordance with the applicable legal acts and the Online Store Privacy Policy.
10. Processing of personal data
10.1. The Buyer’s personal data are processed in the Online Store in accordance with the applicable data protection legislation and the rules established in the Privacy Policy.
10.2. By placing an order, the Buyer agrees that their personal data will be used for the purpose of order execution and, where a separate consent is given, for direct marketing purposes.
11. Amendments and final provisions
11.1. The Seller has the right to unilaterally amend or supplement the Terms by publishing the updated version in the Online Store. The new version of the Terms applies to orders placed after its publication.
11.2. These Terms are governed by the laws of the Republic of Lithuania. Any disputes shall be resolved through negotiations, and if no agreement is reached – in the courts of the Republic of Lithuania at the Seller’s registered address, unless mandatory legal provisions provide otherwise.
